Terms of Use — Venue Application

1. Introduction

GAIA GROUP SE, ID No. 24179787, with registered office at Xaveriova 1946/5, Smíchov, 150 00 Prague 5, Czech Republic, registered with the Municipal Court in Prague under file No. H 464 (hereinafter the "Provider"), is the operator of the website easyjukebox.eu and the easyJukebox Player application (hereinafter the "Application").

The relationship between the Provider and the Venue is governed by these terms and conditions (hereinafter the "Terms"). The Venue agrees to fully comply with these Terms.

A Venue is any natural or legal person who registers and uses the Application to manage a music jukebox at their premises.

The Service refers to the easyJukebox Player cloud application available at player.gaiagroup.cz, which allows the Venue to manage music playback and the music queue for guests at the premises.

2. Agreement to Terms

The Venue is required to read and agree to these Terms before using the Application. By registering an account, the Venue confirms that they have read and agreed to these Terms.

3. Service Description & Subscription

EasyJukebox Player is a cloud-based platform accessible via a web browser that allows the Venue to play music and display the playback queue to guests through the easyJukebox mobile application.

Access to the Application requires an active subscription. Two subscription plans are available:

The Venue receives a free 14-day trial period with no payment details required. After the trial period ends, a plan must be selected and payment made to continue using the Application.

The Provider reserves the right to change subscription pricing. The Venue will be informed of any price changes in advance.

4. Registration & Account Management

The Venue is required to provide accurate, truthful, and up-to-date information during registration and whenever updating their details.

The WiFi network name is required — easyJukebox Player is a cloud application that requires an internet connection. The WiFi password is optional; providing it enables guests to connect automatically via the guest application without asking staff for the password.

The venue address will be displayed on the venue map in the easyJukebox guest mobile application, which guests use to find nearby venues.

The Venue is responsible for the security of their login password and for all activities carried out through their account.

The Venue must promptly notify the Provider of any unauthorized use of their account.

5. Use of the Service

The Application is available as a web application at player.gaiagroup.cz. A modern web browser and a stable internet connection are required.

The cost of the internet connection is borne by the Venue.

One subscription covers the use of the Application on a single computer (PC or Mac) at the premises. Simultaneous login from multiple devices is not supported.

6. Music Licensing

EasyJukebox Player serves solely as a technical platform for managing music playback and queues. The Provider does not provide or facilitate music performance licences for public use at the venue.

The Venue is fully responsible for obtaining the necessary licence for public performance of music. In the Czech Republic, this obligation applies to the collective rights management organisations — OSA (Ochranný svaz autorský) and Intergram. In other countries, the Venue must comply with the relevant local rights management organisations. Operating music publicly without a valid licence constitutes copyright infringement.

7. Use of Google Maps Services

The Application uses the Google Maps Platform API to provide mapping features and display the venue location.

By using the Application, you agree that your use of Google Maps features is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

8. Availability and Changes to the Service

The Provider strives to maintain continuous operation of the Application but does not guarantee uninterrupted availability.

The Provider has the right to make modifications, improvements, or maintenance to the Application at any time, including without prior notice.

The Venue acknowledges that temporary outages may occur for technical reasons and the Provider shall not be held liable for such outages.

9. Subscription Renewal & Cancellation

After the free trial period, the Venue selects a plan and enters payment details. From that point on, the subscription renews automatically for the same period until cancelled.

The subscription can be cancelled directly in the application via Account Settings. After cancellation, access remains active until the end of the paid period.

Important: Once payment details are provided, the subscription renews automatically. To cancel, go to Account Settings → Cancel subscription before the end of the current billing period.

10. Pricing & Payments

Payments are currently processed in US dollars (USD) only. Support for Czech koruna (CZK) is planned for the future.

The cost of internet access required to use the Application is not included in the subscription price and is borne by the Venue.

11. Disclaimer of Warranties

The Application is provided "as is" without any warranties. The Provider does not guarantee that the Application will always be available, error-free, or meet the specific requirements of the Venue.

The Provider is not responsible for issues caused by internet outages, network instability, or Venue equipment failure.

The Venue is responsible for protecting their device and access to the Application.

12. Limitation of Liability

The Provider shall not be liable for any direct or indirect damages arising from or related to the use or inability to use the Application.

The Provider shall not be liable for unauthorized access to the Venue's data or account.

13. Intellectual Property

All intellectual property rights in the Application, including software, interfaces, trademarks, and logos, are the property of GAIA GROUP SE or its licensors.

The Venue is granted a limited, non-exclusive, non-transferable licence to use the Application solely for the purpose of operating a jukebox at their own premises.

Any unauthorized copying, distribution, modification, or further use of the Application or its components is strictly prohibited.

14. User Conduct

The Venue agrees not to use the Application for any illegal or unauthorized purpose.

The Venue shall comply with all applicable laws and copyright regulations, in particular the obligation to obtain a music performance licence.

15. Termination

The Provider reserves the right to suspend or terminate the Venue's access to the Application at any time for violation of these Terms or applicable law, without entitlement to a refund of any unused portion of the subscription.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic.

Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Prague, Czech Republic.
